Eric Millen fined $2500 for offences under the Health of Animals Act

August 20, 2012, Moncton: On July 4, 2012 at the Nova Scotia Provincial Court in Truro, NS, Eric Millen pleaded guilty to one count of contravening subsection 35(1) of the Health of Animals Act and one count of contravening paragraph 35(2)(b) of the Health of Animals Act, and fined $1000 and $1500 respectively.

Mr. Millen was accused of obstructing the work of an inspector on September 1, 2011 by making a false or misleading oral statement to a CFIA Inspector.

Subsection 35(1) of the Health of Animals Act states:

No person shall obstruct or hinder or make any false or misleading statement either orally or in writing to an analyst, inspector or officer who is performing duties or functions under this Act or the regulations.

Mr. Millen was also accused of failing to furnish information to an inspector on September 15, 2011.

Subsection 35(2)(b) of the Health of Animals Act states:

35(2) The owner or the person in charge of a place entered by an inspector or officer under section 38 and every person found in the place shall

(b) furnish the inspector or officer with such information relevant to the administration of this Act or the regulations as the inspector or officer may reasonably require.

The CFIA is responsible for enforcing a variety of federal legislation including the Health of Animal Act.
