Coconut and "Does Not Contain Nuts" Claim

Question:  Can a claim of "does not contain nuts" be made on a product that contains coconut?

Answer: Products containing coconut can declare "does not contain nuts*" with an asterisk referring to a caveat "*contains coconut". This is at the discretion of the manufacturer and is not required. (updated 2008)

Dry Roasted Nuts

Question: Can the claims "dry roasted nuts" and "not roasted in oil" be made on nuts?

Answer: "Dry roasted" is acceptable, as it is not considered an implied claim regarding the fat content of the nuts.

However, "not roasted in oil" is an implied claim relating to the fat content of the food, and may only be made if the principles in the Question and Answers regarding implied claims and FDR B.01.502 are followed. For example, it may be acceptable if preceded or followed by a reduced in fat claim on a product that meets the conditions of this claim. (updated 2008)
 

Nuts - Labelling of Mixed Nuts in the Shell

Question: Does section B.01.071 of the Food and Drug Regulations apply to both mixed nuts in the shell and mixed nuts which have been shelled?

Answer: Yes, section B.01.071 of the Food and Drug Regulations applies to both mixed nuts in the shell and mixed nuts which have been shelled, since the regulation does not specify the form of the nuts to which the requirement applies. (updated 2008)
