T-4-117 - Fees for Consideration of an Application Made Under the Fertilizer Act

Fees for consideration of an application made pursuant to the Fertilizers Act are prescribed in the Canadian Food Inspection Agency Fees Notice. This notice was created under the statutory authority of the Canadian Food Inspection Agency Act. The CFIA Act provides authority to the Minister of Agriculture and Agri-Food, the minister responsible for the CFIA, to fix fees for a service or the use of a facility provided by the CFIA.
Fees
The fees have two important aspects:
- They increase as additional assessment of a submission is required. The increase in fees as additional assessment is required means that an application for registration of a standard product will be less costly than an application for a new product that requires safety and/or efficacy review.
- They are payable at the time at which an application is made. This means that the fees will be deducted when the application is made, regardless of whether or not a registration is later granted.
Fees are in Canadian dollars. Cheques or money orders must be payable in Canadian dollars and payable to the Receiver General for Canada.

The fees for product efficacy assessment (8) and product safety assessment (9) are payable in addition to the fees for product registration (1), product re-registration (2) or amendment of a registration (4). For cases in which no registration exists or is required, fees for product efficacy assessment (8) and product safety assessment (9) are payable if the assessment is required.
It is important to note that the fee payable for consideration of an application will not exceed $1000.00.
Harmonized Sales Tax
All of the fees are subject to the Harmonized Sales Tax (HST).
Examples of types of applications and fees payable:
A. An applicant wishes to register a chemical soil supplement. This product has not previously been used in crop production and has novel claims associated with it.

D. An applicant wishes to amend (major) an existing product registration by adding additional types of crops to which the product can be applied. This requires additional efficacy data. (Note: In this case, the change to the crops on which the product is to be used does not necessitate a safety review; in other cases, a change to the crop(s) will result in a requirement for a safety review.)
