T-4- 94 - Plant growth regulators

This memorandum gives clarification on the status of products with growth regulator claims.

Plant growth regulators may be subject to the authority of either the Fertilizers Act or the Pest Control Products (PCP) Act, or both, depending upon the interpretation of the definitions in the two acts.

Fertilizers Act, Section 2

Supplement means any substance or mixture of substances, other than a fertilizer, manufactured, sold or represented for use in the improvement of the physical condition of soils or to aid plant growth or crop yields.

Pest Control Products Act, Section 2

Pest means any injurious, noxious or troublesome insect, fungus, bacterial organism, virus, weed, rodent or other plant or animal pest, and includes any injurious or troublesome organic function of a plant or animal.

Supplements, subject to the authority of the Fertilizers Act, are products that claim to aid crop yields. They include, but are not limited to, products that directly or indirectly:

Pest control products, subject to the authority of the Pest Control Products Act, are those products that claim to limit plant development or modify physiological, morphological or reproductive processes other than those within the meaning of supplement. They include, but are not limited to, products that:

Applications for evaluation and registration of products with pest control claims only will be reviewed by the Pest Management Regulatory Agency (PMRA) for purposes of the Pest Control Products Act and registered as prescribed.

Applications for evaluation and registration of products with supplement claims only will be reviewed in the Fertilizer Safety Section for purposes of the Fertilizers Act and registered as prescribed.
