Infested Places Order
At Ottawa, Ontario on May 14, 2007
IN THE MATTER OF A BROWN SPRUCE LONGHORN BEETLE INFESTATION WITHIN THE COUNTIES OF HALIFAX, COLCHESTER AND HANTS, IN THE PROVINCE OF NOVA SCOTIA;
AND
PURSUANT TO SUBSECTION 15(3) OF THE PLANT PROTECTION ACT, S.C. 1990, C 22;
Brown Spruce Longhorn Beetle Infested Places Order Second Revision
IT IS HEREBY DECLARED THAT the places set out in the Containment area and forming part of this Order are declared to be infested with the Brown Spruce Longhorn Beetle (Tetropium fuscum) and the movement of the pest, spruce logs, bark and wood chips is prohibited and restricted out of the Containment area.
AND IT IS HEREBY ORDERED THAT:
Interpretation
1. In this Order,
"Canadian Lumber Standards Accreditation Board" (CLSAB) means a corporation (established by the Canadian Standards Association) pursuant to Letters Patent, issued on March 8, 1982 (Film 476 Document 72), and Supplementary Letters Patent (File Number 127741-3), issued on November 10, 2000 under the Canada Corporations Act (1970), as amended;
"Containment area" means the area in and around which phytosanitary measures are applied to prevent the spread of the Brown Spruce Longhorn Beetle from the area of known infestation within the counties of Halifax, Colchester and Hants, in the province of Nova Scotia, as depicted in the Containment area, attached hereto as a schedule;
"conveyance" means any aircraft, carriage, motor vehicle, trailer, railway car, vessel, cargo container or other contrivance used to move persons or things;
"Grading Agency" means a lumber grading Agency accredited by the Canadian Lumber Standards Accreditation Board;
"heat treated lumber" means any dimensional sawn lumber or packaging and dunnage that has been subjected to a heat treatment to attain a minimum core temperature of 56°C for 30 minutes and verified with a stamp (either CLSAB KD/HT for domestic movement, or the IPPC ISPM No. 15 mark, internationally);
"inspector" means a person designated as an inspector pursuant to section 21 of the Plant Protection Act;
"Movement Certificate" means a certificate defined in section 2 of the Plant Protection Regulations, SOR/95-212 and referred to in Part III of the Regulations;
"pest" means the Brown Spruce Longhorn Beetle (Tetropium fuscum) in all its life stages;
"regulated articles" means spruce (Picea spp.) logs, bark and wood chips with a size greater than 4 cm in at least two dimensions.
Prohibitions or Restrictions of Movement
2. (1) No person, except an inspector, shall move the pest into or out of the Containment area unless authorized to do so beforehand by an inspector, in writing, under and in accordance with a Movement Certificate.
(2) Subject to subsection (4), no person, except an inspector, shall move regulated articles out of the Containment area unless authorized do so beforehand by an inspector, in writing, under and in accordance with a Movement Certificate.
(3) Subject to subsection (4), no person, except an inspector, shall move, or cause to be moved, any conveyance that is transporting regulated articles out of the Containment area, unless authorized to do so beforehand by an inspector, in writing, under and in accordance with a Movement Certificate.
(4) No person shall move regulated articles through the Containment area unless the articles are transported in a manner that is not likely to contribute to the spread of the pest.
3. Notwithstanding subsections 2(2), (3) and (4) of this Order, no Movement Certificate is required to transport:
- wood that has been heat treated to attain a minimum core temperature of 56°C for 30 minutes;
- lumber produced by facilities registered by a Grading Agency;
- spruce stems or branches having a maximum diameter equal to or less than 10 centimetres (4 inches) or;
- (d) spruce wood chips with a size less than 4 cm in at least two dimensions.
4. Notwithstanding subsections 2(2), (3) and (4) of this Order, no Movement Certificate is required to transport regulated articles:
- that have been harvested and are being moved within the Containment area or;
- that are being imported into or exported from Canada via any Port within the Containment area.
5. The Brown Spruce Longhorn Beetle Infested Places Order, 1st Revision, dated July 12, 2001, is superceded by this Order.
