Coolwater Fish Ltd. Fined $7,500 for contravening the Fish Inspection Act and Food and Drugs Act

On December 18, 2015, a conviction was registered in the Ontario Court of Justice in Windsor against Coolwater Fish Ltd., operating as Ontario Corporation number 1128800. Sentencing was imposed against Coolwater Fish Ltd. on February 24, 2016. A subsequent appeal by Coolwater Fish Ltd. was dismissed by the Ontario Superior Court of Justice in February 2019, and a Motion for leave to appeal was dismissed by the Ontario Court of Appeal in February 2020.

The court fined Coolwater Fish Ltd., $7,500.

Coolwater Fish Ltd., was convicted of contravening sections 6(1)(a), 6(2)(e) and 6(2.2)(b) and (c) and section 23 of the Fish Inspection Regulations, which is an offence under section 17.1 of the Fish Inspection Act. The offences involved importing fish products without providing proper notification to an Inspector, moving these products without first being inspected or being advised that inspection was not needed and for importing fish products which failed to meet the requirements of the Regulations.

Coolwater Fish Ltd., was also convicted of contravening section 4(1)(b) of the Food and Drugs Act, constituting an offence under section 31.1 of that Act. The offence involved imported fish products, not suitable for human consumption, found in possession for sale. The possession for sale of food products unfit for human consumption is prohibited.

All offences took place between March 25 and June 30, 2011.
