Red Cove Seafood Products Inc. and James Rayner fined and 15,080 pounds of lobster forfeited for offences under the Food and Drugs Act

January 29, 2016, Ottawa: On September 22, 2015, the Prince Edward Island Provincial Court in Summerside convicted Red Cove Seafood Products Inc. (Formerly 7119844 Canada Inc.) of contravening paragraph 4(1)(e) of the Food and Drugs Act. and ordered the company to pay a $7,500.00 fine.

Paragraph 4(1)(e) of the Food and Drugs Act indicates that no person shall sell an article of food that was manufactured, prepared, preserved, packaged or stored under unsanitary conditions.

At the same time, James Rayner, an employee of the company, was convicted of contravening subsection 24(1) of the Food and Drugs Act. Mr. Rayner was ordered to pay a $2,500.00 fine.

Subsection 24(1) of the Food and Drugs Act indicates that no person shall obstruct or hinder, or knowingly make any false or misleading statement either orally or in writing to, an inspector while the inspector is engaged in carrying out his duties or functions under this Act or the regulations.

The Court also ordered that 15,080 pounds of seized lobster be forfeited to Her Majesty in Right of Canada.

On September 24, 2013, Red Cove Seafood Products Inc. was accused of selling lobster that was prepared, packaged and stored under unsanitary conditions. Mr. Rayner was accused of making a false statement in writing to a Canadian Food Inspection Agency (CFIA) inspector on the same date.

The CFIA is responsible for the administration and enforcement of federal legislation, acts and regulations, including the Food and Drugs Act, as it relates to food as defined in section 2 of that Act. The CFIA is dedicated to safeguarding food, animal, and plant health, which enhances the health and well-being of Canada's people, environment, and economy.
