On October 9, 2020, as a result of an investigation by the Canadian Food Inspection Agency (CFIA), 3 charges were laid under the Food and Drugs Act against Distribution Épicerie C.T.S. Inc., located in Montréal, Québec.
The 2 first charges allege that Distribution Épicerie C.T.S. Inc., labelled, packaged or sold a food, namely extra virgin olive oil in 1 litre format, in a manner that is false, misleading or deceptive or is likely to create an erroneous impression regarding its character, value, composition, merit or safety, contrary to subsection 5(1) of the Food and Drugs Act.
Subsection 5(1) of the Food and Drug Act indicates that:
"No person shall label, package, treat, process, sell or advertise any food in a manner that is false, misleading or deceptive or is likely to create an erroneous impression regarding its character, value, quantity, composition, merit or safety."
The third charge alleges that Distribution Épicerie C.T.S. Inc. moved or altered items seized under paragraph 23(1)(d) of the Food and Drugs Act, without permission from a CFIA inspector, contrary to subsection 24(2) of the Food and Drugs Act.
Section 24(2) of the Food and Drugs Act states that:
"Except with the authority of an inspector, no person shall remove, alter or interfere in any way with anything seized under this Part."
Distribution Épicerie C.T.S. Inc. will appear at the Montréal Courthouse, located at 1 rue Notre-Dame Est, Montreal, courtroom 5.08, on November 9, 2020 at 9:30 a.m. (local time).
The CFIA is responsible for the administration and enforcement of federal legislation, acts and regulations, including the Food and Drugs Act. The CFIA is dedicated to safeguarding food, animal, and plant health, which enhance the health and well-being of Canada's people, environment, and economy.
The CFIA issues notifications of charges laid to inform the public when charges have been laid by CFIA's Enforcement and Investigation Services (EIS). Charges are laid by EIS after the Public Prosecution Service of Canada (PPSC) decides to prosecute the charges. This Notice is part of our commitment to openness and transparency and ongoing efforts to increase awareness of our role in encouraging compliance with the various acts and regulations. In all cases, the subject of charges is presumed innocent until proven guilty.
