Notice to Industry - Interim Measure for Test Market Authorizations Requests for Food Additives Use in Processed Fruits and Vegetables Products
March 13, 2017: The Canadian Food Inspection Agency (CFIA) is implementing an interim measure for Test Market Authorizations (TMA) for food additives use in processed fruits and vegetables products. This interim measure will be in place until the Safe Food for Canadians Regulations come into effect.
The current standards for using food additives in processed food, found in the Processed Products Regulations, are not fully aligned with the Food and Drugs Regulations. Because of this, companies have had to request TMAs from the CFIA to use some food additives that are already allowed in Canada.
The Processed Products Regulations allow the CFIA to issue, on request, an authorization to test market regulated processed fruit and vegetable products. The CFIA can issue these TMAs for up to two years, granting exemptions to standard container sizes, other food compositional aspects and food additives. Details are in Part 1.2, Section 9.1 of the regulations.
Once the proposed Safe Food for Canadians Regulations come into effect, and the Processed Products Regulations are rescinded, many food additives used in processed products will be fully compliant and will no longer need TMAs.
In the meantime, the CFIA is implementing an interim measure. It will allow industry to use food additives not currently permitted in the Processed Products Regulations, provided that they are allowed in Health Canada's Lists of Permitted Food Additives, without requiring a TMA.
This measure is in effect now and it will remain in place until the Safe Food for Canadians Regulations come into force.
This interim measure applies only to TMA requests on food additives permitted by Health Canada. The CFIA will continue to review and process TMAs for container sizes and other compositional aspects such as ingredients, drained weights and percent solids.
