Amended Hemlock Woolly Adelgid [Adelges tsugae (Annand)] Infested Place Order

In the matter of a Hemlock Woolly Adelgid infestation located in the city of Niagara Falls, the town of Fort Erie and the township of Wainfleet in the Province of Ontario, the counties of Kings, Lunenburg, Digby, Queens, Shelburne, Yarmouth and Annapolis in the Province of Nova Scotia and the entire Province of British Columbia

WHEREAS, paragraph 15(3)(b) of Plant Protection Act empowers the Minister to determine and subsequently vary the area of any place that is declared infested;

WHEREAS, the Ministerial Order dated December 15 2017, replaced by the Ministerial Order issued on May 28, 2020, declared an area in the city of Niagara Falls, and the township of Wainfleet in the Province of Ontario, the counties of Digby, Queens, Shelburne, Yarmouth and Annapolis in the Province of Nova Scotia and the entire province of British Columbia, infested with Hemlock Woolly Adelgid [Adelges tsugae (Annand)];

WHEREAS, Hemlock Woolly Adelgid has been detected outside of the already declared infested area in the counties of Kings and Lunenburg in the Province of Nova Scotia and the town of Fort Erie in the Province of Ontario;

Therefore, I hereby vary the area of the place declared infested on May 28, 2020 by adding the town of Fort Erie in the Province of Ontario, and the counties of Kings, Lunenburg, in the Province of Nova Scotia as described in Schedule 1.

Interpretation

1. In this Order,

"infested place" means the area described in Schedule 1; (lieu infesté)

"inspector" has the same meaning as in section 3 of the Plant Protection Act; (inspecteur)

"movement certificate" has the same meaning as in section 2 of the Plant Protection RegulationsFootnote 1; (certificat de circulation)

"pest" means the Hemlock Woolly Adelgid [Adelges tsugae (Annand)], in all its life stages, (parasite)

"regulated article" means firewood of all species and plants and plant parts containing bark or foliage from Hemlock (Tsuga spp.), Yeddo spruce (Picea jezoensis), and Tiger-tail spruce (Picea polita) which may include, and is not limited to: plants for planting; Christmas trees; fresh decorative wreaths; foliage and branches; forest products with bark attached such as logs and lumber with bark; bark chips; wood mulch with bark; and dried branches. Prohibitions or Restrictions of Movement

2. (1) No person, except an inspector, shall move or cause the movement of the pest out of the infested place, unless the person is authorized beforehand to do so in writing by an inspector under a movement certificate.

(2) Subject to subsection (3), no person, except an inspector, shall move or cause the movement of a regulated article out of the infested place unless the person is authorized beforehand to do so in writing by an inspector under a movement certificate.

(3) No authorization is required to move any regulated article out of the infested place if the regulated article:

Notwithstanding subsection 2(2), no authorization is required to move or cause the movement of a regulated article out of an infested place if it will be exported via a public port that is located within the infested place, and that the export of the regulated article complies with the Plant Protection Act and Plant Protection Regulations.
